Terms of Use


1. Scope & Parties


These Terms of Use (“Terms”) govern access to and use of the application-programming-interface and related services (collectively, the “API”) provided by Dumpling Software UG (“Company,” “we,” “us”). Each API user (“User,” “you”) enters a binding agreement with the Company by generating an API key, making an API call, or otherwise using the Service.

2. Acceptance & Capacity


By accessing the API you represent that (a) you are legally competent and (b) you have authority to bind any entity on whose behalf you use the API.

3. License & Access


We grant you a limited, non-exclusive, non-transferable, revocable licence to call the API in accordance with these Terms. Resale, sub-licensing or white-labelling requires prior written consent.

4. Data Origin & Ownership


All data delivered via the API originates exclusively from publicly accessible sources supplied by independent third-party data providers. The original data creators retain all intellectual-property rights. No ownership or other IP rights are transferred to you.

5. Compliance With Laws & Third-Party Terms


You are solely responsible for ensuring that your use of the API and any data obtained complies with (i) all applicable laws and regulations, including data-protection rules, export controls and sanctions; and (ii) the terms of service of any platform to which the data relates.

6. Prohibited Uses


You must not use the API to:

  1. Violate laws, regulations or third-party rights;
  2. Process personal data without a valid legal basis;
  3. Interfere with platform integrity (e.g. denial-of-service, excessive traffic);
  4. Engage in fraudulent, deceptive, harmful or unethical conduct;
  5. Attempt to reverse-engineer or gain unauthorised access to the API or underlying systems.

7. Security & Rate Limits


Keep your API credentials confidential. You are liable for all requests made with your key. We may throttle or suspend keys that exceed reasonable request volumes or threaten system stability.

8. Service Availability


The API is offered on a best-effort basis. Functionality may change, be suspended, or discontinued at any time without notice.

9. Force Majeure


We are not liable for delays or failures caused by events beyond our reasonable control—​including platform countermeasures, network outages, legal injunctions, war, or acts of nature.

10. Intellectual Property


All software, documentation and derivative works created by the Company remain our sole property. Except for the limited licence in § 3, no rights are granted.

11. Indemnity


You will indemnify, defend and hold harmless the Company, its affiliates, and their directors and employees from any claim, damage, loss or expense (including reasonable attorneys’ fees) arising out of (i) your use of the API or data, (ii) alleged infringement of third-party rights, or (iii) any breach of these Terms.

12. Warranty Disclaimer


The API and data are provided “as is” and “as available.” We make no warranties—express, implied or statutory—including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement or uninterrupted availability.

13. Limitation of Liability

13.1 We are liable without limitation for intent, gross negligence, and injury to life, body or health.
13.2 For simple negligence, our liability is limited to foreseeable, typical damages arising from the breach of a cardinal duty (Kardinalpflicht).
13.3 We are not liable for indirect, incidental, special, punitive or consequential damages, lost profits or loss of data.
13.4 Mandatory liability under the German Product Liability Act remains unaffected.

14. Governing Law & Venue


These Terms are governed by German law, excluding conflict-of-law principles. Exclusive venue for all disputes is the competent court in Berlin-Mitte.

15. EU Data Act Notice


As of 12 September 2025 we will process any data-access or data-sharing requests in accordance with Regulation (EU) 2023/2854 (“EU Data Act”). Contractual terms shall be fair, reasonable and non-discriminatory as required by that Regulation.

16. Amendments


We may modify these Terms by posting an updated version. Continued use of the API after the effective date of an amendment constitutes acceptance of the change.

17. Entire Agreement & Severability


These Terms supersede all prior agreements regarding the API. If any provision is held invalid, the remaining provisions remain in full force. No waiver of any term is deemed a further waiver of that term or any other.
